A note of caution on the international criminal court trial in Kenya

New report highlights the potentially destabilizing impact of the ICC judicial election-related violence: Kenya 2007

William Ruto-is a candidate in presidential elections scheduled for this December. This case has caused great controversy in Kenya, and has the potential to significantly affect the campaign this year-which included stoking ethnic tensions. If the ICC likes it or not, it is based on working with actors of politics. In the case of Ocampo with regard to the ICC six political action feels wrong to me, at least as far as peace in Kenya.

The report came a warning tone about the case and potential impact. Three key clauses of the report read:

This case has a great political consequences for the 2012 election and stability of the country. Over the years, the case and procedure will undoubtedly decrease or increase the tension com ­ munal. If the ICC is to contribute to the prevention of violence in Kenya’s political future, courts and friends who have to explain the work and limitations better to the public.

Given the political reality that it is possible to go forward, the ICG takes practical approach provides advice to the ICC and the Government of Kenya for how to minimize the effects that potentially incendiary case. In my view the sound recommendations.
